Buy.com.mm Terms and Conditions
These terms and conditions govern the use of Buy.com.mm service.
We will use these terms interchangeably in this terms and conditions statement and the meaning remains the same.
1. Buy.com.mm
1.1 Buy.com.mm is an E-commerce platform selling consumer electronics products exclusively to the WavePay users.
1.2 Products sold on Buy.com.mm are provided by the authorized distributor or reseller of the brand by the trusted Merchants of Buy.com.mm.
1.3 All products sold on Buy.com.mm are covered by the standard brand warranty provided by the Merchants.
1.4 Buy.com.mm Customers are eligible for after sales services provided by the Merchants.
2. Access Restriction
2.1 Participation in the service is open to individuals aged 18 and above who have an active WavePay wallet account, regardless of eligibility to use the service.
2.2 Eligibility will be assessed and updated periodically, and Buy.com.mm reserves the right to modify the eligibility criteria at its discretion.
3. User Information
3.1 Before proceeding, users must agree to these Terms and Conditions and give the consent by providing the required personal information such as NRC or Passport, Phone Number and delivery address to complete the order process.
4. Stock Availability
4.1 Products are subject to availability of Buy.com.mm and we reserve the right to amend the price, limit quantities or discontinue products at its sole discretion without prior notice.
4.2 Once an order is confirmed, customers cannot change the selected product variations.
5. Products and Pricing
5.1 All products listed on Buy.com.mm are subject to availability.
5.2 Prices are displayed in MMK (Myanmar Kyat) and include applicable taxes unless otherwise stated.
5.3 We reserve the right to change prices and product details without prior notice.
5.4 Products, Prices and Promotions on Buy.com.mm are at the sole discretion of Buy.com.mm and the Customer buys as it is stated on the website.
6. Order Placement
6.1 Customers can place orders only for products displayed as available at the Buy.com.mm website through WavePay application or other communication channels determined by Buy.com.mm.
6.2 Orders are confirmed only after payment, i.e. the payment of the product price and the delivery fee, has been successfully processed, and an order confirmation has been issued.
7. Payment Methods
7.1 Payments must be made exclusively through the Buy.com.mm biller account on the WavePay application. All payments must be completed within the specified timeframe and failing to do so will automatically cancel the order. In case of automatic order cancellation, Buy.com.mm is not obligated to make the product available again to the user.
8. Order Cancellation
8.1 Customers may only cancel an order before payment is successfully processed.
8.2 Buy.com.mm reserves the right to cancel orders due to payment issues, stock unavailability, or suspected fraudulent activity. Customers will be notified of any cancellations initiated by Buy.com.mm.
8.3 Buy.com.mm have the right to cancel the order when payment is not made during the specified timeframe.
9. Delivery
9.1By choosing the delivery service, the customer acknowledges that delivery fee displayed at order checkout must be paid upfront along with the product price.
9.2 Purchased products will be delivered to the address provided by the customer during the ordering process.
9.3 Delivery timelines are estimates and may vary depending on the location and other influencing factors.
9.4 Customers acknowledge that any delivery delays or issues related to delivery timelines are the responsibility of the delivery service provider and Buy.com.mm is not responsible for this.
9.5 Customer must present his/her NRC original to the delivery service provider to receive the delivered product. If the Customer is unable to accept the product in person, the Customer must inform Buy.com.mm in advance i.e. before the delivery date of who is going to accept the product upon the delivery and provide Buy.com.mm of this authorized person’s NRC. Failure to show the Customer’s or the authorized person’s NRC will result in non-delivery of the product and the Customer must pay the second delivery fees (if any).
9.6 The delivery charges displayed at the checkout include an insurance service, which provides coverage in case the product is stolen, lost or damaged during delivery. In the event of successful delivery, such insurance coverage is considered utilized and there will be no deduction or refund of the insurance premium.
9.7 Customer must sign and follow the instructions requested by the delivery service provider upon the delivery. Failure to follow such required instructions will result in non-delivery of the product.
10. Pick Up
10.1 The product must be collected at the pick-up location selected by the user during the order checkout process, within the operating hours specified.
10.2 No fee will be applied if the customer opts for pick-up option.
10.3 When the Customer picks up the product, he/she must present his/her NRC. If the NRC is not present, Buy.com.mm reserves the right not to release the product. If the Customer wants to assign another individual to collect the product on behalf of the Customer, Customer must inform Buy.com.mm and follow the process required by Buy.com.mm before the pick-up time.
10.4 Pick-up time and location will be communicated by the Buy.com.mm team. Pick-up is only available during working hours and we apologize in advance for any inconvenience caused.
10.5 Customer must sign and follow the instructions requested by the authorized person from Buy.com.mm upon the pick-up of the product. Failure to follow such required instructions will result in non-delivery of the product.
11. Billing Statements
11.1 Customers are responsible for reviewing billing information during order checkout process and ensuring the accuracy of bill payments made through the WavePay application. Any discrepancies must be reported to Buy.com.mm within 24 hours of the billing statement date.
11.2 Customers can only make the payment via Buy.com.mm through WavePay application within the specified timeframe.
11.3 Buy.com.mm have the right to cancel the order if the payment is not transferred within the specified timeframe.
12. Refunds
12.1 Any order cancellation initiated by Buy.com.mm due to price changes or stock unavailability or delivery issues shall result in a full refund to the customer.
12.2 Refund for above specified scenarios shall take 48xx hours from the time when the order cancellation is initiated.
13. Returns
13.1 Once the product has been delivered or collected, we do not accept the returns and will not process for the refunds.
13.2 In case of the factory error, Customer may contact us, and we will assist the customer in resolving the matter with the Merchant and/or manufacturer.
13.3 Buy.com.mm is under no obligation to accept the return of any product sold on the platform. Once a product has been delivered and/or collected, it is the sole responsibility of the Customer.
14. Warranty
14.1 Products sold on Buy.com.mm include manufacturer warranties. Please refer to the product details for specific warranty terms.
14.2 Buy.com.mm is not responsible for warranty claims but will assist in directing the customer to the manufacturer for resolution.
15. User Responsibilities
15.1 Customers must provide accurate personal information for the ordering and delivery process.
15.2 Customers have the responsibility to check the product for any defects and malfunctions at that point of delivery or collection and need to raise any such issues found with Buy.com.mm immediately and directly. Buy.com.mm shall support the Customers at the best of its knowledge with the Merchants in case of factory malfunctions.
15.3 It is not Buy.com.mm and its Merchant’s responsibility in case of the product malfunction caused by the Customer.
15.4 Customer must inform Buy.com.mm and/or its Merchant within 5 days in case of the factory error. Buy.com.mm cannot guarantee the factory error reports that are made after 5 days from the delivery/collection.
16. Prohibited conduct
16.1 Customers using Buy.com.mm may not engage in activities that
- violate applicable laws or regulations
- Infringe on the rights of others, and/or
- Disrupt the operations of Buy.com.mm.mm.
17. Privacy and Policy
17.1 Buy.com.mm will handle customer information in accordance with applicable privacy laws.
17.2 By using Buy.com.mm, you consent to the practices described in our privacy policy.
17.3 All communications between you and us in relation to these terms and conditions and agreement shall be in both English and Burmese. In the event of any discrepancies or inconsistencies between the English and the Burmese version, the English version shall prevail and be deemed authoritative.
17.4 By using Buy.com.mm services, you have agreed to receive our promotions and news via SMS, Email or WavePay account.
18. Intellectual Property
18.1 All content on Buy.com.mm including images, logos and text is the property of Buy.com.mm and is protected by copyright and trademark laws.
18.2 Unauthorized use of Buy.com.mm’s content is strictly prohibited.
19. Amendments to Terms
19.1 Buy.com.mm reserves the right to amend these terms and conditions at its sole discretion at any time without advance notice to customers.
19.2 Continued use of Buy.com.mm after any changes that we have made constitutes acceptance of the revised terms and conditions.
20. Complaints
20.1 If you have any complaint or feedback about our services, please inform us via email at hello@buy.com.mm or contact us via 09949238837, we will do our best to resolve the matter as soon as possible.
21. Governing Law
21.1 This Agreement is governed by the laws of the Republic of the Union of Myanmar.
21.2 Any disputes arising from or related to this Agreement will be resolved through arbitration administered by Myanmar Arbitration Center in accordance with the laws of the Republic of the Union of Myanmar.
